GIFT CARD Rules – Amaryl Wellness & Bali Spa

1. Organizer

1.1. The organizer and issuer of the Amaryl Wellness & Bali Spa Gift Cards (hereinafter referred to as gift cards) is S.C. BF Class Expert, with registered office in Brasov, str. Carpaților, nr. 1, working point in str. Negoiu nr. 6, ap. 4 jud. Brașov, registered with the Trade Register under no. J08/387/2018, CUI RO 38890348, hereinafter referred to as “Amaryl Wellness & Bali Spa“.

2. Conditions of purchase

2.1. Anyone who wishes to offer a gift in the form of spa services: massages, body shaping procedures, cosmetic procedures at Amaryl Wellness & Bali Spa, can purchase gift cards to offer to anyone they wish.

2.2. Gift cards can be purchased by any natural or legal person, domiciled or established in Romania or in the European Union.

2.3. Gift cards can be purchased in physical format, either at the Amaryl Wellness & Bali Spa premises or on the website: www.amaryl.ro/en

2.4. Gift cards are available with values of your choice, the minimum value required being 200 lei (VAT included). To give the gift of a complete spa experience of relaxation and body remodelling, we recommend the purchase of gift cards:

• Silver Spa Experience, 720 lei (VAT included), includes 3 therapies of your choice.
• Gold Spa Experience, 1440 lei (VAT included), includes 6 therapies of your choice.
• Platinum Spa Experience worth 2880 lei (VAT included), includes 13 therapies of your choice.

2.5. Each card has a unique value written on the front and a unique series on the back, which will be filled in when the card is purchased.

2.6. The price of each gift card is equal to the value written on each type of card, but this value must be at least 200 lei (VAT included).

2.7. Payment must be made in lei.

3. Conditions of use

3.1. The gift card can only be used in the Amaryl Wellness & Bali Spa salon located in Negoiu Street, nr. 6, ap. 4, for the purchase of spa services provided by the salon. The list of Spa services and their prices can be consulted at www.amaryl.ro/en/packages-prices.

3.2. The card is not nominal and is therefore transferable.

3.3. The gift card is valid for a period of 6 calendar months and can be used during these 6 months. In order to use it, it is necessary to schedule the first session in advance and determine with the Spa therapist which services will be included in the gift card.

The value of the Spa services purchased must be equal to or greater than the amount on the card. If the value of the services exceeds the face value of the card, the difference will be paid by any other means of payment accepted by Amaryl.

3.4. A person may hold more than one gift card at the same time.

3.5. No change will be given on gift card purchases.

3.6. The gift card cannot be used to purchase another gift card.

3.7. Gift card balance cannot be transferred or redeemed.

3.8. The value of the gift card cannot be returned to the original purchaser or the subsequent holder.

3.9. The gift card is valid for 6 calendar months from the date of purchase. After the expiry of the validity period, its value becomes null and void and the gift card can no longer be used to pay for the spa services purchased. After the expiry of the validity period, the balance of the gift card is considered lost; the gift card holder is fully responsible for the expiry of the validity period and is not entitled to any compensation from Amaryl Wellness & Bali Spa. The expiry date of the gift card can be checked against the date of purchase on the back of the gift card.

4. Payment of gift cards and delivery terms and conditions

4.1. Payment of gift cards can be made in lei at Amaryl Wellness & Bali Spa, Negoiu str. no. 6, ap. 4, by card or cash. For gift cards ordered online, on the website www.amaryl.ro/en, through the order form, payment is made online by card, through the online payment processor NETOPIA Payments.

4.2. Order confirmation is done in writing, by email, within 24 working hours.

4.3. Gift cards are payable and can be picked up at Amaryl Wellness & Bali Spa in Brasov, str. Negoiu nr. 6, ap. 4. The cards can also be delivered to the beneficiary by courier for a fee, if the beneficiary lives outside of Brasov. The cost of transport will be paid directly to the courier. The delivery time is a maximum of 3 working days.

5. Conditions for return/ cancellation

Once purchased, an Amaryl Wellness & Bali Spa gift card will be physically returned to the headquarters in Brasov, str. Negoiu nr. 6, ap. 4, within a maximum of 14 calendar days from the date of purchase, i.e. the invoice date. For cancellation and return of the card, the gift card must be presented and sent to Amaryl Wellness & Bali Spa in physical format, undamaged, and the purchase invoice must be presented.

6. Litigation

6.1. Any disputes arising between the organizer and the purchasers/ users of the gift card will be settled amicably or, if this is not possible, will be settled by the competent Romanian courts.

6.2. The applicable law is Romanian law.

7. Protection of personal data

7.1. Amaryl Wellness & Bali Spa is a personal data controller within the meaning of Regulation (EU) 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter GDPR Regulation). In this role, Amaryl Wellness & Bali Spa guarantees compliance with the legal provisions on the processing of personal data.

7.2. Natural persons whose data are processed in connection with the purchase and/ or use of gift cards are data subjects within the meaning of the GDPR Regulation.

7.3. Unless otherwise provided by law, Amaryl Wellness & Bali Spa guarantees that the rights of data subjects will be respected:

• the right of access, i.e. the right to obtain confirmation from Amaryl Wellness & Bali Spa that we are processing your personal data, as well as access to your personal data and information about the processing;
• the right to rectification which refers to the correction, without undue delay, of inaccurate and/ or incomplete personal data;
• the right to erasure/ right to be forgotten, i.e. the right to erase without undue delay the personal data collected, if these data are no longer necessary for the purposes for which they were collected and there is no other legal basis for the processing, the data have been unlawfully collected or the data need to be erased in order to comply with a legal obligation;
• the right to restriction of processing which applies if (i) you contest the accuracy of the personal data, (ii) the processing is unlawful and you object to the erasure of the personal data and request instead the restriction of processing, (iii) Amaryl Wellness & Bali Spa no longer needs your personal data, but you request it for the establishment, exercise or defence of legal claims, (iv) you have objected to the processing for the period of time during which it is verified whether our legitimate interests in the processing of personal data outweigh your rights;
• the right to object to processing, unless we can demonstrate that we have legitimate grounds for processing your data, overriding your interests, rights and freedoms or for establishing, exercising or defending a legal claim;
• the right of portability, i.e. your right to receive the personal data you have provided to us for the purposes set out herein in a structured, commonly used and machine-readable format, and the right to send this data to another controller;
• the right to file a complaint with the National Supervisory Authority for Personal Data Protection (ANSPDCP);
• the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly affects you, unless such processing is permitted by law.

With the exception of the right to complain to the ANSPDCP as set out above, these rights may be exercised by sending a written request:

• by mail, to our office in Brasov, Negoiu str. nr. 6, ap. 4, jud. Brașov;
• by e-mail, to the attention of the Amaryl Wellness & Bali Spa Data Protection Officer at the following e-mail address: office@amaryl.ro

8. Final clauses

8.1. The gift card is a bearer product, non-nominal, being transferable by simple remittance from one person to another, the responsibility for its use resting solely with the holder. The Card is transferable and may be used by a person other than the person to whom it was offered by the original purchaser. Amaryl Wellness & Bali Spa assumes no liability and will not replace the gift card(s) in case of theft, loss, misplacement or damage. In such cases, the balance of the gift card is considered lost and no compensation can be made in relation to the event that led to the gift card holder being unable to use the gift card.

8.2. Amaryl Wellness & Bali Spa reserves the right to change the rules for the use of the gift card; any changes will be communicated in writing on the official website www.amaryl.ro/en

8.3. By purchasing/ using one or more gift cards, customers agree to abide by and comply with all provisions, terms and conditions of these Rules.

8.4. The Rules are available, free of charge, to any applicant on the Amaryl website – www.amaryl.ro/en
